A representative for the company said Thursday: “We take this business and this regulation very seriously, and our obligations very seriously,” adding, “The bankruptcy court has granted ESM the authority, under the federal coal leases to operate the mine, and ESM continues to do that in accordance with that direction from the bankruptcy court.”
